Compliance news that matters to you Tips Corner Top 4 things to get started on your Export Controls (Licensing) Compliance program; 1. Start an Export Compliance Team within your organization. Have one person from sales, customer service, shipping, purchasing, accounting and upper management. Become familiar with www.bis.doc.gov as it is responsible for implementing and enforcing the EAR – Export Administration regulations. 2. Lookup and verify that your export is NOT listed on the CCL – Commerce Control list located at the bottom of the EAR on the BIS website www.bis.doc.gov. You can do this by making sure there are no matches of your product listed on the CCL in the form of an ECCN – Export Control Classification Number. Then make sure you are compliant with all 10 general prohibitions in the EAR Part 736. 3. If you do find your product on the CCL verify if there are any license exceptions that you might qualify for. If none then goto the country chart in Part 738Spir of the EAR and see if there is an “x” in the box for the country you are exporting to. If no “X” then a license is NOT required. If there is an “x” then you need to apply for a BIS export license. 4. You can apply for a BIS export license right from their website using the SNAP application. I would recommend allowing 30-60 days for a license approval. I would recommend each company review the CCL at least once a year for every product you export that is subject to the EAR. Military items are governed by the Dept of State. You can find more information on that license process at www.pmddtc.state.gov . Exporting without a license can carry severe penalties.
