Compliance news that matters to you

Hello and welcome to Allocca Enterprises first quarter 2007 electronic newsletter. Thank you to all of you who have either attended one of my training programs, allowed me to provide an in-house training at your facility or who has taken advantage of the compliance audit & consulting services. Having learned so much from each of you either from a class or from visiting your facilities, now it is time I share some of those best practices back with you.

Tips Corner

Top 3 things to get started on your Export Compliance program;

1. Get management commitment, preferably a “C” level executive, and have them put it in writing. It can say something to the effect of, it is the companies polices and procedures to comply with all U.S. Export Administration Regulations.

2. Lookup and verify that you are using an up-to-date and accurate Schedule-B number (HS) and verify there are no current export licenses required for your export. Create a product database, and list the proper Schedule-B # and ECCN –Export Control Classification Number (if applicable), next to each product.

3. Put it in writing. Any good export compliance program must be in writing. It doesn’t have to be fancy, just list who is responsible and what are your internal export procedures. Get started today so you are compliant tomorrow.

U.S. Department of Commerce

2006 Annual report – Read how there has been a near doubling of administrative penalties over the previous year. The average combined civil & criminal penalty is $213,235. (Both civil and criminal fines are usually given in combination of one another) This does not include attorney fees, loss of export privileges, jail time or bad press.

U.S. Customs & Border Protection

About every 5 years the US International trade Commission updates the HTS classifications. As of Feb 3rd, 2007 – US Customs has updated 83 out of the 97 HTS chapters in the US harmonized tariff. There are over 240 changes in the tariff. If you are importing or plan to import, I would recommend you goto the below website and look up the changes to see if you classification has been changed.
